BREXIT

On 31 December 2020 the transitional period of the withdrawal agreement (Brexit) came to an end, which meant the end of the free movement of people and workers between the European Union and the United Kingdom.

  • EU citizens residing in the UK before 31 December 2020.

EU citizens and their family members who wish to continue to reside, work or study in the UK after 30 June 2021 will be required to apply (including minors) for a residence permit under the EU Settlement Scheme, a UK Home Office procedure. This requires the EU citizen to be resident in the UK by 31 December 2020. On the basis of the EU Settlement Scheme ('EUSS'), two statuses will be granted.

- Settled status or indefinite leave to remain, for those EU citizens and family members who have been continuously resident in the UK for more than 5 years.

- Pre-settled status or limited leave to remain, for those EU citizens or family members who have been resident in the UK for less than 5 years. Those citizens who obtain pre-settled status, when they have reached 5 years continuous residence in the UK, must apply for settled status or indefinite leave to remain. It is necessary to apply for settled status before the pre-settled status expires. The Spanish embassy has a special office to assist Spanish nationals with EU Settlement Status.

  • EU citizens arriving in the UK after 31 December 2020.

They will need to apply for a visa to study, work or visit the UK: https://www.gov.uk/check-uk-visa
